Defined as: Entities that sell or contract to sell operational anti-personnel mines for consideration to a state or non-state purchaser. Production, procurement, transfer, transport, export, or distribution without a commercial sale is insufficient.

Arms Brokers or Dealers Facilitating a Commercial Sale
Defined as: Entities that negotiate, price, arrange, or broker a commercial sale of operational anti-personnel mines between third parties.
- 03Criterion
Seller-Side Government Contractors in Mine Sale Agreements
Defined as: Entities contracted by a government to offer, price, contract, or fulfil the seller-side commercial sale of operational anti-personnel mines. Buyer-side procurement authority is assessed under Anti-Personnel Mines Acquisition and Procurement.

Commercial Sales Packages That Specifically Include Anti-Personnel Mines
Defined as: Entities participating in a documented commercial weapons sale in which operational anti-personnel mines are expressly included as a priced or contracted item.
- 05Criterion
Digital Platforms or Catalogues Enabling a Commercial Mine Sale
Defined as: Entities operating digital marketplaces, catalogues, or transactional platforms that knowingly list, price, solicit orders for, or enable the commercial sale of operational anti-personnel mines.
- 06Criterion
Corroborated Sale Evidence From Authoritative Investigations
Defined as: Entities for which an NGO, treaty monitor, UN body, government record, sanctions or enforcement record, or other authoritative investigation provides an exact legal-entity, product, sale, and time attribution concerning treaty-defined anti-personnel mines, and the assertion is corroborated by a primary source or another independent authoritative source. List membership or a combined controversial-weapons list alone is insufficient.

These circumstances do not establish this activity unless separate evidence also meets an inclusion criterion.
- 01Criterion
Sale of Anti-Vehicle or Command-Only Devices Without a Victim-Activated Mode
Defined as: Entities that sell only anti-vehicle mines or command-detonated explosive devices that require deliberate human activation and have no available mode triggered by the presence, proximity, or contact of a person. Sensor technology, remote delivery, self-destruction, self-neutralization, or self-deactivation does not by itself place a victim-activated mine outside the treaty definition.
- 02Criterion
Historical-Only Sale
Defined as: Entities with verified past sale or brokerage of sales of operational anti-personnel mines or the applicable outside-definition devices, where reliable evidence establishes that the qualifying activity has fully ceased, been divested, transferred, dismantled, terminated, or otherwise ended and no current qualifying involvement remains. Historical-only activity does not qualify as current involvement. Preserve the historical record separately with the activity period, effective cessation or transfer date, relevant entity, product, programme, facility, or contract, and supporting evidence. Absence of recent evidence alone is not sufficient to establish cessation.

Component Suppliers Without End-Use Knowledge
Defined as: Firms that sell generic parts (e.g., casings, electronics) without evidence of intended use in anti-personnel mines.
- 04Criterion
Sale of Inert, Demilitarized, or Training Mines
Defined as: Organizations selling deactivated mines or replicas used for display or training, not for operational use.
- 05Criterion
Non-Selling Manufacturers or Transporters
Defined as: Companies involved in mine production or logistics without involvement in transactional or pricing activity.
- 06Criterion
Humanitarian Mine Action Organizations
Defined as: NGOs or clearance firms involved in handling recovered mines for destruction or evidence, not for sale.
