Defined as: Entities that research, design, engineer, prototype, or materially improve a treaty-defined cluster munition, cluster payload, explosive submunition, explosive bomblet, or cluster-specific component. Generic delivery-platform development is insufficient.

Explosive Submunition or Bomblet Development
Defined as: Entities that design, prototype, test, or qualify explosive submunitions or explosive bomblets intended to be dispersed or released from another conventional munition.
- 03Criterion
Cluster-Specific Testing and Qualification
Defined as: Entities that conduct explosive testing, range trials, reliability testing, qualification, or performance validation for an identified cluster munition, explosive submunition, explosive bomblet, or cluster-specific component. Generic range or laboratory services are insufficient.
- 04Criterion
Patented or Proprietary Technology Applied to Cluster Munitions
Defined as: Entities that hold or develop proprietary technology and provide evidence that it is applied to an operational cluster munition, explosive submunition, explosive bomblet, or cluster-specific component. A patent or possible technical use alone is insufficient.
- 05Criterion
Current Cluster Munition Development Programmes
Defined as: Entities with a documented current technical deliverable in a government-funded, company-funded, or joint cluster-munition development programme. Country-level capability, a retained right to produce, or programme naming without an identified deliverable is insufficient.
- 06Criterion
Development Subcontractors With a Direct Technical Deliverable
Defined as: Entities contracted to perform cluster-specific design, engineering, prototyping, testing, or qualification work. Generic materials, ordinary components, staffing, or administrative support are insufficient.
Excluded on this basis alone
These circumstances do not establish this activity unless separate evidence also meets an inclusion criterion.

Manufacturers Without R&D Activity
Defined as: Companies that produce or assemble cluster munitions but are not engaged in design or developmental work.
- 02Criterion
Academic Institutions with Humanitarian Research
Defined as: Universities or NGOs studying cluster munitions only for humanitarian impact, clearance strategies, or policy reform—not weapons development.
- 03Criterion
Generic or Dual-Use Technology Without Cluster-Munition Integration
Defined as: Entities developing guidance, sensors, fuzes, explosives, electronics, aerospace systems, rockets, missiles, artillery, aircraft, or simulations without evidence that the work is specifically designed, significantly modified, or integrated for a cluster munition or explosive submunition.
- 04Criterion
Historical-Only Cluster Munition Development
Defined as: Entities with verified past research, design, engineering, prototyping, or testing of operational cluster munitions or cluster-specific components, where reliable evidence establishes that the qualifying activity has fully ceased, been divested, transferred, dismantled, terminated, or otherwise ended and no current qualifying involvement remains. Historical-only activity does not qualify as current involvement. Preserve the historical record separately with the activity period, effective cessation or transfer date, relevant entity, product, programme, facility, or contract, and supporting evidence. Absence of recent evidence alone is not sufficient to establish cessation.

Simulation or Training Tool Developers
Defined as: Entities creating virtual models or inert training aids for education or disposal training, without developing functional weapons.
- 06Criterion
Generic Components or Materials Without Technical Development Role
Defined as: Entities providing ordinary parts, raw materials, explosives, electronics, or services without cluster-specific design authority, engineering responsibility, or a documented technical-development deliverable.
