Defined as: Entities that manufacture explosive submunitions or explosive bomblets designed to be dispersed or released from another conventional munition and to detonate before, on, or after impact.
- 02Criterion
Dedicated or Significantly Modified Cluster-Munition Components
Defined as: Entities that manufacture a component specifically designed, exclusively used, or significantly modified for cluster munitions and that performs a material function in dispersal, release, detonation, targeting, fuzing, integration, or operation. Examples include dedicated dispensers, canisters, ejection mechanisms, fuzing units, bomblet casings, and cluster-specific submunition parts.
- 03Criterion
Documented Integration and Material-Function Test
Defined as: Entities that supply a part or assembly where credible evidence establishes the specific product, integration into an operational cluster munition or explosive submunition, and a material technical function. Customer identity, general military use, or possible compatibility alone is insufficient.
- 04Criterion
Submunition or Cluster-Specific Component Assembly
Defined as: Entities that assemble explosive submunitions, explosive bomblets, or cluster-specific components into an operational subassembly or munition subsystem. Generic contract manufacturing without product attribution is insufficient.
- 05Criterion
Cluster-Specific Component Development, Testing, or Qualification
Defined as: Entities that design, develop, test, qualify, or materially modify an identified cluster-specific component, explosive submunition, or explosive bomblet. Generic laboratory, simulation, or test-range services are insufficient.
- 06Criterion
Exact Transaction Role for Cluster-Specific Components or Submunitions
Defined as: Entities that knowingly sell, broker, transfer, distribute, import, export, or transport explosive submunitions, explosive bomblets, or dedicated cluster-munition components. The exact product and transaction role must be established; one transaction activity is not inferred from another.

- 01Criterion
Generic or Dual-Use Items Without Dedicated Design, Significant Modification, and Material Function
Defined as: Entities supplying generic electronics, metals, explosives, casings, mechanical items, aerospace components, software, sensors, fuzes, or other inputs where the item is not shown to be specifically designed, exclusively used, or significantly modified for cluster munitions and to perform a material function in the weapon.
- 02Criterion
Delivery Platforms or Launch Systems Without a Cluster Payload or Dedicated Component Role
Defined as: Entities that provide aircraft, launchers, artillery systems, rockets, missiles, vehicles, or other delivery platforms without supplying an integrated cluster-munition payload, explosive submunition, explosive bomblet, or dedicated cluster-specific component.
- 03Criterion
Products Outside the Cluster-Munition Definition and No-Submunition Replacement Warheads
Defined as: Entities supplying only unitary or pre-formed-fragment warheads without explosive submunitions; flares or pyrotechnic devices; smoke, chaff, electronic-effect, or air-defence munitions; mines; or single-target munitions meeting the controlling technical exception for fewer than ten submunitions, each weighing more than four kilograms, designed to detect and engage a single target object, and equipped with electronic self-destruction and self-deactivation features.
- 04Criterion
Humanitarian Clearance, Demilitarization, or Destruction Components
Defined as: Companies providing equipment, tools, parts, or services used solely to detect, clear, neutralize, deactivate, dismantle, destroy, or safely dispose of cluster munitions, explosive submunitions, or explosive bomblets.
- 05Criterion
Inert, Replica, Training, or Display Components Only
Defined as: Companies providing inert, demilitarized, replica, training, or display components with no operational explosive function and no role in producing, assembling, or restoring operational cluster munitions.
- 06Criterion
Historical-Only Cluster-Specific Component or Submunition Involvement
Defined as: Entities with verified past development, production, assembly, supply, sale, transfer, distribution, import, export, or transportation of explosive submunitions, explosive bomblets, or dedicated cluster-munition components, where reliable evidence establishes that the qualifying activity has fully ceased, been divested, transferred, dismantled, terminated, or otherwise ended and no current qualifying involvement remains. Historical-only activity does not qualify as current involvement. Preserve the historical record separately with the activity period, effective cessation or transfer date, relevant entity, product, programme, facility, or contract, and supporting evidence. Absence of recent evidence alone is not sufficient to establish cessation.
